My sister won her ESA appeal in December. She was placed in the WRAG.On 2nd of this month, she was called for the first time to the Job Centre for an appointment which only lasted 5 minutes. She was only asked her birthday and her children's names and birthdays. The lady typed something on her computer and then told my sister "you will be seen by a personal adviser at your local JC."Next thing she was called by someone from A4e at the work program. She was sent a letter next for an appointment with somebody from A4e.Is this right? Shouldn't she have to undergo 6 WFI before being sent for the work program? In the mean time she has been sent another ESA50.Could anyone clarify this please?

Hi A,
Besides the two links that I previously provided for you, have a look at :
CHAPTER 2
CLAIMANT RESPONSIBILITIES
Introductory
13 Work-related requirements: introductory
From page 15 onwards of the new Welfare Reform Act 2012, which has just gained Royal Assent, from this document :

Claimants are being referred to the Work Programme when their current prognosis is three months for ESA(CB) and six months for ESA(IR).
I'm afraid there is no "minimum" number of WFIs before referal takes place.
It is also common for a new ESA50 to be issued after a successful appeal, usually because the time taken for an appeal to be heard, exceeds the re-assessment date that would have been allocated, had the claimant been awarded ESA orginally.

With respect to the your sister being sent a new ESA50 to complete, after only being placed in the WRAG on appeal in December.
Don't forget that the award of WRAG given at appeal would have been backdated to the time of the original adverse decision that was appealed. So in effect, your sister will have been deemed to have been in the WRAG since then.
It seems to be the norm that claimants are receiving new ESA50's and being re-assessed shortly after winning an appeal.

As far as I am aware the 3/6 month referral times have not changed.
What has changed is what you can be expected to do under the Work Programme.
Remember, not everybody will be referred to the Work Programme at this stage, it will depend on the nature of yor disability and some "expectation" as to whether a re-assessment would still find you have Limited Capability for Work. Also, anything you are asked to do on the Work Programme must take into account your disability.
