Does that mean my ESA(cb) will be stopped almost as soon as i finally get my award? I first began claiming on 10th march 2011 and only won my appeal on the 14th feb 2012 (to be back dated until 9th may 2011), as yet i still don't even know what group i've been put in? I keep ringing them but are getting nowhere, i just keep being told it hasn't been sorted out yet?! :(

I'm afraid with the current delays in the appeal system, this is a real possibility for many claimants.

Please have a look at the link to our FAQs that Mrs H posted, as there may still be other options.

Thank you Gordon

It looks like it will be stopped as my husband works a 40hour week. When deciding on IR on low income do they take into consideration what income is left after rent & community tax is paid? or on the whole income? Because once we have paid our Rent & CT we have less money than if my hubby claimed JSA for us both, seems crazy..

If we are assessed on his income without rent & CT taken off we would be almost £100 per month better of on JSA!!! :(

I'm afraid it sounds like you fail on two counts, see

24 hour work rule for ESA(IR)

Asset rule for ESA(IR)

Income rule for ESA(IR)

This is just crazy my husband only brings home £233 per week our rent is £122.84 pw and our CT is £32 which will leave us £78.16 to leave on. On JSA as a couple we will get £105 pw and pay no rent or CT. I'm sick of being penalised because i did work & my husband does work..... It really doesn't pay to work in this country anymore!!! The only extra money that we are getting at the moment is ESA at the lower rate as my appeal award hasn't been sorted out yet... But it will stop as soon as i get it!
It looks like we will be better off if my hubby gave up work!? :(

I really don't know what we're going to do, i used to have a well paid job at the nhs before i came ill... As i've been slowly improving my DLA appeal that i also won is only limited until 3rd sept 2012.. but now finding out that it looks like i'm going to losing my ESA soon is going to set me right back again with all the stress :(
