help EAS50 was created by srthomas
Hi
2 weeks ago I received a phone call from DWP saying that because I’m on ESA in the work group and have been receiving payment for the last 2 yrs then this will stop at the end of April, which I was expecting; I also rang DWP to confirm this and was told the same. Today I received, through the post ESA50 form to fill out, my question is this worth my time doing this and going through another stressful ATOS assessment to be placed in the work group again and not receive any payments because I have already been paid 12 months, or is it best to bin it. Thanks

Hi ST,
You can still claim ESA for NI Credits only.
However, you will still have to go through the ESA Re-assessment process for entitlement to the above.
Also if you are placed in the Support Group this time, you will again become entitled to ESA, whilst you remain in the SG.
The decision is yours to make.

We can't advise on this, but you may want to consider the following.
If you believe you meet the criteria for the Support Group, and are successfully place in it, then your ESA(CB) entitlement will continue.
Even though a claimant may have lost their entitlement to ESA(CB), they can continue to claim NI Credits toward their State Pension, this is dependant on their continuing to meet the requirements of ESA.
If you suffer from a deteriorating condition, and at some time in the future would expect to meet the requirements of the Support Group, you can re-claim, and if successful, would be placed in the SG and your ESA(CB) re-instated. Whilst the rules for this, in practical terms are not entirely clear, maintaining your eleigibility for ESA is fundamental to this happening.

my age is 55yrs and my cotribution for my state pension (if I ever get it) are all paid for, I know I will not get any help because i have a works pension and my wife is in work so what is the benefit of filling this form?

If you have acondition that is likely to deteriorate over time, you might qualify for the support group at a later stage. You would able to do this via the contributary route if you have continued to be unfit for work in the meanwhile. This condition can only be met by submitting to regular reassessments.
Only you can say whether you think it is worth the agro.
