ESA Being Stopped

ESA Being Stopped was created by Pusscat
I have found out that my ESA will cease completely at the end of April, I was receiving contribution based benefits. I will not be entitled to any other benefits as my husband works.

I have severe medical conditions. I can provide them if necessary. I am awaiting a kidney/pancreas transplant, I am not on dialysis.

I need some advice on what to do and I am totally confused and very frightened by this.

Please can somebody help and give some advice?

Many thanks

I am afraid your options are very limited as this is not a Decision you can appeal.

If you believe you qualify for the Support Group, you can request a Suppersession of your claim, however, your payments will still cease while this happens. If you are found to be eligible for the SG, then you will receive back payments and your ESA(CB) will be re-instated, however, if you are still placed in the WRAG you will receive nothing. See

Qualifying for the Support Group

Alternatively, you can try and re-qualify for ESA(CB), you will need to wait 12 weeks before making a new claim, and you will need to meet the qualifying Conditions.

I have very recently received an ESA50 which I sent back in February. I have heard nothing back from that, and I am not sure what to do. I am sorry, but this is all very, very confusing and worrying.

I was told if I re-apply it will probably be rejected which was not very helpful, to say the least. My conditions have however worsened since my initial claim due to the deterioration of my kidneys and the fact that I am being worked up for a transplant.

Can you shed anymore light on things with this info. It will be appreciated?

Thank you

Hi PC,

As you did not mention that you have recently had to fill in and return an ESA50 due to re-assessment of your WRAG award in your original post, you still have a chance that you may be placed in the Support Group, on this re-assessment.

If your conditions have deteriorated since returning the ESA50, and you have not yet received a decision on a new award of ESA, you should send any fresh evidence of this deterioration in your conditions and resulting limitations to ATOS at the same address as you sent your ESA50 to ASAP.

You should also send copy of any fresh evidence for the attention of the ESA Decision Maker, address this to the benefits office on any letters that you have regarding your ESA.

Make sure that you put your name, NI Number, and DOB, on any pages sent as fresh evidence, and keep copies.

State in a covering letter that you wish this fresh evidence to be taken into account in your current re-assessment.

It may be best to post both to ATOS and the ESA DM by recorded delivery.

If you can gain entry to the Support Group under this current re-assessment, then your ESA payments should continue at SG rate after April 30th, as long as the SG award is made before then.

Ok, thank you. Sorry I omitted those details, but my mind has been a bit of a turmoil this afternoon.

I am being worked up for a kidney/pancreas transplant and also have to have an as unknown heart condition investigated on angiogram. I can get a letter from my docs no problem to detail these new conditions and send it to the JC plus office and also ATOS.

He did do a letter for me, but it missed going with the ESA as he had been on holiday and I had to get it back before he returned. Is it ok to submit something after the ESA has gone back. If so I'll contact him tomorrow and ask for it urgently?

Thanks

Hi PC,

I do understand your predicament. :)

The sooner that you can obtain and send copy of any supporting evidence to ATOS and the DWP DM, the better.
