ESA claim Nil points. was created by Girl_interrupted
I have read loads on the forum about my appeal and I kinda know what to do.
I really need to call into question the competence of the 'nurse' at my medical as she was so unprofessional and the report itself is mainly false.
She has painted a picture of a woman who flies around in taxi's daily visiting her friends and 'doing lunch' which could not be further from the truth.
Anyhow, I have written a 6 page appeal pointing out her inconsistencies and I'm taking it to the CAB on Thursday to have them check it - but now I am fretting and being sick because the way they look at it is if I can write an appeal I'm fit for work. Though the thing is I suffer from Bipolar and depression I'm not stupid.
Or if you ask the 'nurse' I've just got 'low mood'
Could the appeal letter be written by my partner as my representative, who is also my carer as ironically I receive DLA.
OH and does anyone know of any groups that are 'fighting' (maybe thats the wrong word)the way the goverment treat people like myself with mental health issues as I would be very interested in joining them.
Any advice would be welcome as I need to get this letter sent away to receive the appeal payments, I don't remember what they are called my head hurts.
Many thanks and kind regards.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

GI
There is no reason why your partner can't write on your behalf, although they should explain why they have done this and that they are recording your words and not penning theirs.
Whilst it is important to undermine the medical report, especially if you believe there to be errors, however, you should not focus on this exclusively.
You will only win your Tribunal by showing that you meet sufficient of the ESA descriptors to score 15 points or more for the WRAG or one or more of the descriptors for the Support Group.
Have a look at the following.

Oh, I dunno...I'm all confused.
I have listed all the headers from the notification and pointed out the inaccuracies and said what I don't and can't do.
Thanks for the advice

G-i, as Gordon said, you need to do more than discredit the nurse in order to win your appeal. You need to clearly show how your condition fits the criteria for the support group.
Good luck!

Yeah, The report says I make snacks and drinks...and I never said that....so I've said no I don't I can't remember the last time I cooked a hot meal.
That kinda thing.
My own GP wrote in his report that I find it difficult to hold down a job because of my condition...I reminded them of that when she said there was no evidence to suggest this. No, only the final written I got for calling someone a Kn** they are by the way.

Cooking a meal might be relevant to how long you can stand, or whether you can lift but it is not, by itself, a descriptor for ESA. Nor is not being able to hold down a job in the past. You really need to look at each descriptor and explain clearly how you meet it.
