To follow on form my post re home visits from DWP. I was notified Dec 2011 that I have been overpaid benefits. In Jan I began the migration from IB to ESA. I successfully migrated into the Support Group in March 2012 and literally the following day I was notified that I would be having a Home Visit from the Disability and Carers Service. This happened on Monday 2/4/2012. The guy from the DWP was really friendly but literally the delivery guy of the letter advising a massive overpayment of benefits. I am now entering negotiation to pay the amount off with the Debt Recovery Dept!

If the overpayment of benefit was due to an official error made by the DWP then you shouldn't have to pay it back, see This link

The DWP appealed to the Supreme Court but this jurisdiction upheld the decision of the Court of Appeal, and the appeal was unanimously dismissed. See:-
