I have just read something on another forum that has somewhat alarmed me, and I am hoping for some reassurance that it's all a mistake and not a new policy.
The person involved has recently failed their ESA medical but thought they would be able to reapply as it was 6 months since their assessment. They have been told by the DWP today though that it has to be 6 mths from the tribunal.
Even worse they asked a Welfare Rights advisor to clarify this and was told that they now class a tribunal as an assessment. Surely that can't be correct? If that were true then people would not be getting new ESAs straight after their tribunal - or has that stopped happening all of a sudden?
I know the DWP can often get it wrong but it sounded worrying as the Welfare Rights person seemed to be backing it up. Anyone else heard anything of this?

It would be interesting to read the article you are referring to, but to re-assure you I am not aware of any changes to the ESA legislation which would result in the situation you describe.

Sorry, I should have been clearer... it was a post put on by someone not an article, so hopefully it was based entirely on misinformation on both sides!
