We are about to send back our son's ESA50 - he has been on income support and high rate DLA care for a number of years - he has a severe mental illness and is being re-assessed.
My question is that we have a letter from his physciatrist supporting his assessment and we also have a "fit note" from his doctor saying that he is not fit for work and has signed it for six months and said that he will not need to see him again after the six months is up. Do you think that we should send the "fit note" with his ESA50 and other documents or not send it because the doctor has said that he can't put any more than six months on the form, or leave it in case they turn him down and we could use it if we appeal.

If your son is being transferred from IS due to Incapacity to ESA, then there is no requirement for you/him to provide a Fit Note.

You can include it with the ESA50, and it may be of some value, however, unless the doctors comments on the Fit Note directly addres one or more of the ESA criteria, it is unlikely to be given much weight by the Decision Maker.
