Appeal pending, now got new ESA50 was created by horsey
I put in an appeal against being put in WRAG instead of Support Group and am awaiting a date. I've now had another ESA50 which I have completed and returned.
As I'm sure I will have to go for another Atos medical is there any point in putting myself through the trauma of an appeal, should a date come through soon, when any decision is likely to be superseded by the medical if it comes later?
As I'll have had my 365 days by October on ESA (C) and am not entitled to Income Based, what is the point of calling me for another medical anyway?

Only you can decide whether you wish to continue woth your appeal under the circumstances.
However, as to your point about reassessment. You need to consider whether you wish to keep your claim open (in order to claim NI credits and if you think you might meet the support group criteria at a later stage). If so, you will need to attend this 'medical' and go through whatever periodic re-assessment you are subjected to.

Just to add to Mrs H's comments.
The Tribunal re-makes the Decision that you are challenging, so if you won your Tribunal and were placed in the Support Group, then at the very least the Time Limit count will stop until a new Decision is made on your claim, meaning an extra x days before you reach the magic 365.
