I think the position has changed over the last couple of years.

Originally, you were required to sign the medical report at the end of the assessment, which of course necessitated that it be completed, however, since this requirement was removed, the doctor can complete the report after they have left.

On this basis I think it likely that they will refuse.

You can request a copy of the report from the DWP, however, based on ESA procedures, they may be unwilling to release a copy until a Decision has been made, but there should be no problem after this.

Hi

I had my DLA medical assessment last friday my CPN couldnt be present but my 20 year old son was and was taking notes. The Doctor arrived 20 mins early despite me telling him NOT to arrive before 11, theres a suprise!! He marched into my house and proceeded to growl at me because I couldnt remember his name (I did say on my form that my shorterm memory is awful due to the ME and FMA). I asked him if he had any understanding of my illness and got a short YES LOTS. He then looked at my medicines and questioned whether my GP had given me the correct medication intimating that he hadnt. What came next was nothing short of bullying despite him knowing in advance that I am still suffering from PTSD after fleeing a mentally and physically abusive partner. He fired questions at me for an hour and forty five minutes and when I refused to go up to my bedroom with him and to do things that exhabited my pain he was nearly at shouting at me point. Sorry for the long post I know he will fail me and I dont know it I have the strength to fight them anymore.

I've given up trying to predict the outcome of medicals based on the attitude of the "doctor", we often hear of failed claims when they are supportive and succesful ones, when the claimant though they did not stand a chance, hopefully yours will be one of the latter.

With regard to the "doctors" behaviour during the medical, you are entitled to be treated with respect and they should take into account you condition when asking you to do things, so if you feel that the "doctor" fell short in one or both of these areas, then you should consider making a complaint to ATOS, see

You are perfectly within your rights to complain to both DWP and ATOS about the way you were treated.
