hi I have been to see welfare rights today as i am appealing for esa he told me that i would be loosing my assesment rate ESA because they include any time you were on incapacity benifit as well I have been on esa assesment rate since january but on IB for over 10yrs can you clarify this please A

No, time spent on IB does not count towards the 365 day limit. It is only time in the WRAG (and in the assessment phase in some cases) that is counted.

thanks so does that mean the 365 days will be from when i started getting assesment rate in january thankyou although i have to say it dosn"t look to hopeful if my representative for my appeal got it wrong thanks again A
