Jobcentre Plus was created by benefits61
I cant breathe I cant stop crying and dont know where to turn. briefly I had a medical in June 2011, placed in WRAG. Wrote to Jobcentre and was told my case was being sent back to the decider- Sept 2011. Since then I cant get them to talk to me I have written left messages in the call centre not a word. I went for medical no 2 14th May 2012. Four weeks ago I asked my MP to write to them for an explanation, they replied to him (but not me) to say I would have a decission and explanation by 8th June TODAY. Indeed a letter did come today to say they were stopping my contribution base ESA on 1st Aug.
I think I need legal help its all beyond me and its making me more and more ill. Do you know where there is a list of solicitors who specialise in this.
Thankyou
Annken

Can I just clarify your post.
You were originally assessed for ESA in June 2011 and placed in the WRAG.
You say you wrote to the JC+, was this because you felt you should be in the Support Group?
Did you (a) request a Reconsideration, or (b) request an appeal?
Did you receive any correspondance as a result of your letter?
You were re-assessed in May 2012 and you are still waiting a Decision?
Are you receiving Contribution Based ESA?
If you are receiving ESA(CB) then the letter notifying you that your ESA is stopping is related to this and is the result of you having been in the WRAG for at least 365 days. This is not an appealable Decision, see
12 Month Limit for ESA(CB)
If the new Decision (that you are waiting to hear about), places you in the Support Group, then payments willl be re-instated, if you are placed in the WRAG again, then you will only be entitled NI credits that count towards a full State Pension.
With regard to the letter you sent, I would first recommend that you seek advice from a qualified benefit advsisor, see
Where to get advice?
Most solicitors have no benefit knowledge and even those that do are unlikely to have any more than a good advisor.

Thankyou so much it feels very lonely out here as I am sure you and everyone visiting the site.
I got 15 points in my first medical and place in LCWG. I went for an interview where tey said it would be difficult to place me and havent heard anything since.
The JC+ said it was a good group for me to be in and not to appeal, by phone.
When I found the LCWG was time limited I questioned their advice to me and was told in writing that they would send it back to the decider to see if the decision could be looked at again. that was Sept 2012, that was the last I have heard from them until today despite many requests. Oh and the form and letters for another medical. I dont know if Im going round twice or just going round the bend.
Thankyou

Based on your latest post it would sound like a Reconsideration was requested, although the informality of the request e.g. over the phone, may mean that it was lost in the DWP systems and that this is why you never received any updates.
Whilst this is unacceptable and you ar entitled to make a complaint, see
Complaining to the DWP
the two issues that result are proving that the request was made and more importantly, whether you qualify for the Support Group.
To qualify for the Support Group you need to meet one or more of the SG criteria, see
Qualifying for the Support Group
If you believe this was the case when you asked for a Reconsideration, then this is certainly a matter worth you pursuing as it can effect whether you should continue receiving your ESA payments.
With regard your current assessment, if you are placed in the WRAG and you believe you should be in the SG, then you can appeal the Decision, but you will not receive any payments while you do. If you win then payments should be backdated and your ESA re0-instated.

Thankyou I have asked for all corispondance to be in writing but as you know they (JC+)would rather talk on the phone.
I have complied fully with all their requests , as has my GP. Feel very tired.
