ESA REASSESSMENTS was created by shrinathji
Hi All,
When you are being reassessed for ESA within a year, and you submit new ESA form, do DWP look at the previous form that you have sent with all the additional info????
or do you have to assume that they will not look at your previous form and send in a whole load of info including a repatition of what you have already sent.
Thanks.
Radhika.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

There are two aspects to this.
First, although the DM should have access to the information from your previous assessment, you cannot assume that they will look at this in detail, if at all.
Secondly, a re-assessment is a review of your condition as it is now, not as it was and therefore you need to, wherever possible, present new evidence and information. Of, course, many claimants have permament or deteriorating conditions, but even in these circumstances, you still need to show that this is the case.
Whilst the onus lies with the DWP to show that you no longer meet the descriptors at a re-assessment, the reality is that a claimant would be doing themselves a dis-service not treat each re-assessment as if it was the first.

As far as I remember, at rereferal scrutiny, they look at the current ESA50/ESA50A any information supplied by the claimant, the previous ESA85 if you had a face to face, or an ESA85A if you didn't. They will also consider any IB85's held if you had a PCA for IS/IB. They are required to look at any further medical evidence, which they are in possesion of already. They also look at records of any phone calls, made to health professionals in connection with your claim and sometimes with the claimant.
I don't believe they keep old ESA50/ESA50A forms, and I feel it may be in your best interests to resubmit any further medical evidence when returning your form. If any of this is incorrect I'm sure someonne will come along to help.
