FMS AND ME was created by Gentle Spirit
Hi I had a DLA 'Medical' recently at my house, despite being asked not to arrive before my appt at 11am the doctor was banging on my door at 10.30am I know this is not uncommon. On coming into the house he said im here to assess you about your CFS no mention of my Fibromyalgia which is a major part of my problems. The gentleman was at my house for 2 hours during which he tried taking my blood pressure over my jumper?? and also asked me to go up to my bedroom despite being told that I was very wary of strangers especially men due to being physically and mentally abused.I refused which seems to of counted against me (it is mentioned on his report). As expected my DLA claim has been refused although I have been on it for the past 3 years. I am appealing but do you have any indication of how long I am going to have to wait for the appeal and if my money will be backdated if I win? I live in the highlands of Scotland.
Many thanks to you all.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

The DWP will carry out a reconsideration first, your case will then go o appeal if the recon does not go in your favour. At the moment the whole system is running very slowly - I have heard of reconsiderations alone taking up to 4 months, then even longer for the appeal.

Thank you for your swift reply is it unusual for them to only mention one part of someones illness as at no point did he mention my fibromyalgia which causes me to be in complete unceasing agony. I felt bullied because I was so stressed I kept getting things wrong.

It is certainly not unusual for people to be dissatisfied with the 'medical' assessment!

Should I win my appeal is the money I should of been awarded backdated from when they stopped it?
