DLA do they get longer to respond was created by Trundles
Hi all,
Still working on my appeal. just wanted to know, I sent a letter to the DLA asking for all the documents and emails used in making their decision (as suggested on this site) I believe they have 40 days to respond to this? During this time though I decided to appeal as I only had 30 days to get that letter to them. I am still waiting for the info (past 40 days now) do they get longer as Iv now said i want to appeal or should I be getting in touch with them. I phoned them before I sent in the appeal form and they said someone was getting it all together.

As far as I am aware, the fact that you have submitted an appeal does not change the 40 day desdline in any way.

many thanks for that I guess now I have to get in touch with them. Is it then relevent to my appeal that they have gone over the deadline

You can complain to the DWP about their tardiness in this matter - but I don't think it has any bearing on your appeal.

Did you request the information by letter, or by a Subject Access Request, if the former, then there is no timescale for the DWP to respond, the 40 days only applies to SARs.
