DLA Backdated - Carers Question was created by shrimp
hi all
i do not come on hear much but often pop on to keep upto date on whats happening etc - good news further down so read on.
i have fibromyalgia and endometriosis and need a lot of help from partner
on my first year of dla got HRM LRC, 2nd yr got HRM and after asking for review HRC (partner DID not claim carers allowance at this time as he was still working part time), my partner eventually got signed off by his GP with depression as the toll of running round after me/twin boys, running house and parttime work took its toll, by this time my next DLA was HRM and LRC - asked why it was reduced but they just said it was so left it at that.
meanwhile partner with much aggro got esa altho physically ok for work mentally he wasnt and in the real world he couldnt, he then got chucked off as the 365 rule came round - even tho he was waiting tribunal? presume thats off then?
anyway, this yrs renewal came thru and again awarded HRM and LRC so wrote and said why downgraded from other year, etc etc, today received letter saying they have now awarded me HRM until 2017 and HRC until 2017 - it also says on letter that HRC awarded from 2010-2012 - does this mean that they are backdating it?
if so my ? is - if they made a mistake and i should have been awarded HRC 2 yrs ago and my partner could off claimed carers - can i now get carers backdated until then?
any advice hugely appreciated, thank you to this site for info and used a lot of it for my forms and other letter
you have to keep on to dla to get what you need...
thanks mich xx

Congratulations on your DLA award.
Your husbands appeal should still be valid even though he is no longer receiving what I assume was the ESA Assessment rate while he waits for a hearing.
You need to contact the DWP office that dealt with your DLA claim as to what, if anything the reference to "2010-2012" means.
If you MRC is backdated then it may be possible for your husband to backdate a claim for Carers Allowance to when he stopped work, but you will need to talk to the Disability and Carers unit about this as the normally allowed period is three months.
