to remain on incapacity benefit was created by bob
Hi all
After sending in myESA50 form i got a letter telling me that a mistake had been made and my National Insurance Credits would still be paid and they would treat me as being on Incapacity benefit indefinatly.
great you might think?
i,m 56 but do not get any Incapacity benefit ,due to not keeping up with my stamps.
I was hoping to at long last get some benefit ,seems to me that all the talk about eveyone going to be transferd to ESA is not true.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Bob
You might want to get some face to face advice regarding this.
Where to get advice?
As we understand it, nobody should be left on IB who doesn't meet the exclusion rules.
You don't say why your IB wasn't in payment and even if you did, we can only give a general answer.
On the assumption that you were receiving NI Credits before the non-transfer, have you checked to see whether you have accrued the 30 years normally needed for a full State Pension?
