I have now received a letter from ATOS,firtly saying sorry for phoneing me when i said not to and for making my appointment on a date i said i could'nt make.
They've also addmitted the HCP has made a number of innacurate entries in the report,both in the mental examination anf the physical examination.

That is a good start! You need to be aware that this could lead to you undergoing another face-to-face assessment if DWP/tribunal service do not believe they have enough information to make a decision. It is still up to you to show how you meet the Support Group descriptors.

If i had to go for another face to face would'nt that mean they would have to re-instate my benefit rate back to what it was(i.e. not the assessment rate)until the outcome of the possible new face to face assessment? After all it would be the fault of the HCP that i needed to go for another,meaning the first assessment was void because of the number of innacuracies.

Also the atos customer relations medical adviser(CRMA)has advised that all these "deficiencies" be brought to the attention of the decision maker in the DWP in order that they may consider whether any further action is required.
Can i take this as gospel that atos will have advised the DWP of all these deficiencies,and can i demand to see ALL the defiancies the CRMA has found as the letter does'nt go into great detail.

I believe you are appealing a Fit for Work Decision so you are only entitled to the ESA Assessment rate.If i had to go for another face to face would'nt that mean they would have to re-instate my benefit rate back to what it was(i.e. not the assessment rate)until the outcome of the possible new face to face assessment? I would would seperately contact the DWP in writing and send a covering letter with a copy of the letter you have received from ATOS.Re:my last post

You should be able to request any additional issues that are in the report from the DWP, this will likely be contained in any report that ATOS are sending to the DWP.
