Based on your previous posts, your time in the WRAG was time limited by the 365 day rule.To add to my original post... on the 16th October i was telephoned by a DWP DM who told me i had won my appeal and was going to be placed back into the WRAG for 12 months... after 6 1/2 months of no money i was pleased at the result even though it was the support group..... however after 3 weeks still no money... rang up half a dozen times to be told loads of different stories ...then in the end i was told that although i had won my appeal i wasn't entitled to anything as i had not paid enough stamp, as on ESA they only pay class2 stamp.... after 7 months and winning my appeal i am left with nothing but a bad head and sleepless nights.
On this basis, since the Tribunal placed you back into the WRAG, payments could not be restarted as you still fall under the 12 month limitation.
You may be able to make a new claim for ESA(CB), based on your NI Contributions (not NI Credits), during the tax year 2009-2010, however, I note that your original ESA claim started in 2009, so this will depend on how long you worked for and how much you earned, after April 5 2009.
I am assuming that you have checked to see whether you are eligible for Income Related ESA?
