HI

My ESA(CB) stopped on 30th April due to the time limitations, i was put into WRAG. I didn't realise that i could reapply if i had enough NIC and my condition hasn't improved. What i would like to know my hubby is claiming JSA as he was recently made redundant, if he was to claim for just himself could i still claim ESA(CB)?

If you are both claiming a Contribution Based benefit then it should be no problem, however, JSA(CB) is only payable for 6 months after which it becomes Income Based and your ESA(CB) will be considered income.

I would advice you to get face to face advice before making a claim to ensure that you understand your options fully, and to ensure that you can meet the 3 contribution rules.

Making a new claim for ESA(CB) is not clear cut as you will still have an active ESA claim which will need to be cancelled, removing any right to a re-assessment if you meet the Support Group criteria at a future date, also a new claim cannot be made immediately because of the 12 week linking rule.

I was on Incapacity Benefit for 12 years.
Does that mean I have accrued 12 years of
National Insurance credits, equivalent to
12 years?

Yes, you should have accrued 12 x 52 weeks of NI Credits.
