ESA or Poverty ? was created by frisbydoo
I'm about to receive yet another ESA50 & Medical etc.
I know my wife and I are not strong enough to go any further!
What sort of penalties would we be subjected to i.e., would we have to provide any refund?
We're just too tired and would rather live in poverty than go six foot under.....!
Regards

Nothing on this board constitutes legal advice - always consult a professional about specific problems

If you decided to no longer claim ESA, you would not have to pay back any benefit that you have already received.
I would urge you to get some face-to-face advice before you make any such decision

Hi fb,
If you fail to return your ESA50 by the deadline given, and can not show good cause for this, your file will be returned to the DWP DM, and your benefit may be stopped.
If you fail to attend a face to face assessment, and again can not show good cause, you will be classed as "fit for work".
It is by no means a definate that you will be asked to attend a "medical" if you do return the ESA50, many members are awarded ESA without the need for a "medical".
If you choose to opt out of ESA, then one of your other choices would be to "sign on" for JSA.
I really would advise that you think seriously before making such a decision.
Many members have had worries such as yours, but have then gone on to successfully be awarded ESA, with the help of our guides.
You should take face to face advice regarding your options, see :
Where to get advice?
Have a look at our :

ESA FAQ’s
Of course it is only a decision that you can make, but all on B&W, members and Mods, will help as much as they can.
