Income related ESA is awarded if the claimant's income is low enough and contributary benefit cannot be awarded.
It is possible to get contributary ESA with an income related top up if income is low.
Income related ESA also enitles the claimant to other benefits, such as free prescriptions.

Would somebody please be kind enough to explain to me what the difference is between contribuition based esa and income based esa, this is all too much for me, thank you,
Hi t,
CB ESA would be paid to a claimant if they had the necessary National Insurance Contribution history obtained from employment, or if they were being transferred over from Incapacity Benefit (IB) or Severe Disablement Allowance (SDA).
IB ESA would be paid to a claimant who did not have the necessary NI Contribution history, gained through employment, or to those claimants who have been transferred over to ESA from IS on the grounds of incapacity for work.
Some claimants will be entitled to CB ESA with an IB ESA top up, just as claimants in receipt of IB may receive an IS top up. This would be the case is certain personal circumstances, e.g, where the claimant was entitled to "Disability Premiums" where they are in receipt of Middle or Higher Rate Care of DLA.
NI CONDITIONS FOR CB ESA :
You must have paid enough national insurance contributions to qualify for contribution-based ESA . In general, you need to have actually paid 25 x class 1 or 2 contributions in one of the last 3 tax years; and have paid or been credited with 50 x contributions in both the last 2 tax years.

First, in order to claim ESA(CB), you need have accrued sufficient NI Contributions in what are called the qualifying years, in practice (and simplified), this means you need to have worked or been engaged in registered self-employment during the two full tax years prededing the date of your claim.
ESA(CB) claims are always made by an individual, your assets are not considered, however, some forms of income, such as a pension, can reduce your payments.
If you don't qualify for ESA(CB), you may be eligble for ESA(IR), subject to you and your partner (if applicable), meeting the associated means test, this includes your joint income, your joint assets, and if you partner works the number of hours they do this for.
ESA(IR) whilst in the name of the claimant, applies to the couple, and as such, payments are slightly higher than for ESA(CB). As with all Income Related benefits, such as IS, the payable amount can be increased by the inclusion of a number of Premiums.
It is possible to be eligible for both ESA(CB) and ESA(IR) if your income is low enough, with the ESA(IR) paid as a top up to the ESA(CB).

Am I right in assuming that if you yet it and are in the WRAG group on cb based, at the end of the 365 days you automatically get trasfered to income bade esa.

In the first instance, you will need to contact your local DWP ofice.Just wondered how you apply for the income based too up. I have been wondering this for a few day, as I keep reading about it.
Am I right in assuming that if you yet it and are in the WRAG group on cb based, at the end of the 365 days you automatically get trasfered to income bade esa.

If you appear to be eligible you will need to complete an ESA3 form which collects details of your financial situation.
Assuming everything is OK, you will intially have your ESA(CB) topped up with ESA(IR), if your ESA(CB) is then time limited then the ESA(CB) componet of your payment will stop and you will continue in payment with just ESA(IR), the amount you are being paid should not change.
