Hi, i am appealing to be put in the support group and have requested info on how they came to their decision. I have received a letter stating that they cannot find the relevant papers but are still pursuing their whereabouts! I wasn't called for a medical, but the nurse who completed the medical has assessed me as having a significant level of disability due to fibromyalgia, such that i would have limited capability for work. His prognosis is that a return to work is unlikely for at least 2 years!(my GP says I'll never work again). I suffer bowel incontinence and IBS but he has come to the conclusion that there is no evidence to suggest this occurs even though I sent in medical evidence. How can this guy come to this conclusion?? At the end of the letter is the following sentence "you should note that the ESA85A has been prepared for state benefit purposes only, and may only apply for a limited period".Does anyone know what this means? I'm sorry if i've gone on a bit, its so frustrating!!!

"you should note that the ESA85A has been prepared for state benefit purposes only, and may only apply for a limited period".Does anyone know what this means?

This means that the ESA85A, which is the medical report generated by the ATOS HCP when there is no face to face, (Paper scrutiny alone), is only pertinent to the WCA process of ESA (benefit purposes).

Although a DWP DM can use any medical reports at his disposal to come to a decision on an award of benefit. (e.g. an ESA medical report may be referenced by a DM when making a decision on DLA or vice versa)

The limited period bit means that when you are due to be re-assessed, a new medical report will then be generated.

Hi Bro58, thank you for your prompt reply/explanation.In the interim I decided to telephone ESA and ask them what that meant, the lady who answered my call didn't know!!! Thank goodness for B&W!
