ESA Appeal Process

I am in the process of appealing I asked the DM to look at the decision again at being placed in a work group instead of the support group the DM did not change the original decision therefore I appealed against the decision, sent the GL24 form, the DM and Appeals team have sent a letter stating they will look at the decision again and asks for further evidence which supports my appeal. If I have further evidence which supports my appeal do I have to send the evidence at this time or can I wait until the papers are sent from the court?

Hi B,
If the DWP are to look at the decision again (Reconsider it), and you wish to try and avoid the lengthy wait for an appeal hearing, it would be advisable to send any fresh evidence to the DWP ASAP.
There is clearly no benefit in waiting until it is sent forward to the Appeals Tribunal Service.

Is there a time limit on this evidence being submitted to the DM?
Hi B,
We used to advise that a reconsideration could take upto 11 weeks.
However, in these times that may well not be the case, we have heard of members waiting many months for a decision on a reconsideration, others have had decisions within a matter of days.
Therfore, my best advice would be ASAP.
