Also could i ask concerning esa form has anyone with mental illness actually stated on their form that there would be a risk to mental health if found fit for work and if so did they have evidence to back this up, many thanks.

Hello thought i would share my news, i got my dla renewal decision letter today after a 3 year award. i was awarded same rates as before but this time for indefinate period which is great, i gather until pip catches up with me.is there any info i can request from dwp that will explain their decision. i have basic reasons on my award letter but like to have full details for my own peace of mind.

With regards to ESA, I obviously cannot speak for other members, but gather that you are refering to "Exceptional Circumstances", as in :
WRAG, Reg 29 : www.legislation.gov.uk/uksi/2008/794/regulation/29/made
SG, Reg 35 : www.legislation.gov.uk/uksi/2008/794/regulation/35/made
There is nothing wrong with mentioning that you feel that you may qualify for WRAG or SG under the above, but be aware that the "Burden of Proof" will be on you to prove that there would be "substantial risk".
