esa appeal

Hi, currently waiting for the esa appeal papers to come.
Is there any information on how the appeal waiting list is organised.

For example I was on IB and waiting for my appeal the other claimant was on esa and waiting for their appeal.
Will one of these claimants get to the appeal hearing before the other. Or is it organised by the date the appeal is filed.

As far as I am aware, it is first in, first out, with the exception of adjourned hearings, which are prioritised.

You can get an earlier hearing, by waiving the right to two weeks notice, but you should only do this if all of your evidence has been submitted and you are happy to go to a hearing immediately, as you will be offered the slot from a cancelled hearing at the very short notice, maybe the next day.

Im a bit paranoid with the DWP and wouldnt rule out underhanded tactics here.
My benefit is being cut by £40 a week while waiting for my appeal. They would have nothing to lose by delaying my appeal for as long as possible,
On the other hand a new esa claimant who appeals the decision would have less to lose while waiting for an appeal, infact some who are playing this system will be hoping their appeal takes forever.

The Tribunal service is independent of DWP, there would be no benefit to them if they were to manipulate the dates of appeals in this fashion.

Its not the Tribunal service I have the problem with. It would be the stage before it goes to them, where the Jobcentre holds the appeal papers.

Have you had your reconsideration yet? This is, indeed, the part of the procedure that is in the hands of DWP (I waited 6 months for my recon). Once the appeal has been passed to the Tribunal service, DWP will have no further control over the timing.
