Thanks Mrs H.
I understand the transitional rule but in my case the occupational pension is due after I was transferred so I'm a little confused about the prior to 2001 rule.

The pension has to have been paid since 2001, anything after that date will have the normal IB and ESA rules applied to it; an £85/w disregard followed by £1 deduction for every £2 in excess. Thanks Mrs H.

Is the £85 a gross amount before tax, or if tax is deductable from the pension is it net amount of pension payment after tax?

I believe it is after deductions, however, with any question of this type, you should get face to face advice in order to get an accurate understanding of your situation. Is the £85 a gross amount before tax, or if tax is deductable from the pension is it net amount of pension payment after tax?
