At the new tribunal:- I have a new panel (judge & doctor, Will they start again or will they go on from my first trial. I was awarded with 18 points at first and then when I had my tribunal they knocked my points down to 6 points. I have wrote to ask for the reasons why but was sent a letter saying that the decision had been set aside, I will recieve a new date in the next 3 months. Will they be able to also reduce my points. My money as now stopped,I was in work related activity group. I think I should have been placed in the support group. My doctor as been a good help sending them a letter. Asking them to set aside they results. I am going back to my doctor for more help in the next day or two as I believe with out his letter last time saying Im not fit for work, I would not have had my trial set aside. As anyone gone through this please if you have can you give me some advice thanks.
The new tribunal will start from scratch again and look at your situation as it was when the very first decision was made.
Yes, this tribunal also have the right to reduce your points and find that you are not entitled to ESA - but they are supposed to warn you if his looks likely and give you the chance to withdraw your appeal.
