any repercussions? was created by princess1
Hallo again,

I receive a very small amount of ESA (IR) now, over the past months my partner has received a small increase in his pension
which was deducted from my ESA and on top of that I now receive
a small pension which was, as you know, deducted £/£ from my ESA. I have made enquiries and have another small company pension I can access, if I stopped the ESA (IR) top-up , and moved on to the other company pension, would I have any repurcussions? I am assuming that I would not have any more
assessments/forms to fill out/medicals/work programme etc.
but my knowledge of the whole system is extremely limited and I
always expect a minefield to open up at every stage.
kindest regards and many thanks once again for any advice you can supply.

I think this is one of those situations where you would be best to get personal advice

Where to get advice

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hallo again, can I assume from your reply that there are likely repercussions to be expected?

Possibly not, however it is impossible to say without knowing much more about your circumstances - and this would not be appropriate in this forum.

Hallo , what would the general run of the mill repurcussions
incorporate? I find it difficult to come up with anything
other than financial and even that with difficulty. I seem to be missing the point and any reason for repurcussions in the first place. :) Ta much!

Hi P,

As MHB has correctly advised, you should obtain professional advice, where the adviser will have access to all your personal details.

As a generic response, in other words, not pertaining to you personally.

If a claimant was in receipt of an IR ESA top up, but then lost entitlement to the IR ESA top-up, they may also lose entitlement to passport benefits, such as full HB, CTB, Free prescriptions and dental care.

If a claimant was in receipt of CB ESA in the WRAG, with an IR ESA top up, but then lost entitlement to the IR ESA top up, as they would then only be entitled to CB ESA in The WRAG, they would then only be entitled to this CB ESA in The WRAG for 365 days, whereas there is no such 365 day entitlement limit whilst you receive any amount of IR ESA in The WRAG.

Further, if you are entitled to claim an occupational pension from a certain date, and fail to claim it, The DWP can deem you to be in receipt of it anyway, once they are made aware of this fact.

So, as you can see, this is why you need professional advice, as it is not something that we could offer a definitive answer to on the Forum. There may well be even more possible implications than I have mentioned above.

You may wish to use this : Benefits Calculator , to gain a broad idea of what you may stand to lose, but should still gain professional advice.
