Is it an advantage to have a representative with you at an appeal?
How long does it take for the DWP to reconsider the decision and then submit the papers to the courts? I have been waiting since September - is that normal?

Hi B,
Success rates are greatly improved with professional representation at appeals tribunals, the problem being that is becoming far more difficult to obtain such representation.
11 weeks used to be the guidelines for time taken to carry out a reconsideration. However, as with a lot of issues, this seems to have gone by the board.
So, I'm afraid it is another of those "how long is a piece of string" ? scenarios.
You could of course contact the DWP at the office that is dealing with your ESA, to request an update.

I have just joined the site as I am so frustrated with the wait since I had my medical assessment way back on August the 9th.
I sincerely hope that they will reconsider the decision which went against me. I scored 12 points and was removed from the support group and deemed fit for work.
I appealed and, together with a strong letter from my GP outlining my condition, I hope I have done enough to be put back where I was.
I just wondered if this was normal to wait this long for a decision. I phoned the DWP a fortnight ago but the girl I spoke to couldn't give me any sort of update other than that they had recieved my sick note which I sent months ago.
