Advice please DLA severe disability premium

Hi, please let me know. I have been in assessment phase of ESA for 12 moths, going to appeal tomorrow. I also applied for DLA in Jan this year and they finally reconsidered their decision and overturned it 8 weeks ago, therefore i was entitled to 9 months backdated benefit. Today my DAB advisor has told me he wont be able to represent me tomorrow as he believes i will stand a better chance of ESA if i withdraw my appeal and entre a fresh claim. My health has gone down hill a lot since the original decision of the doctor at Atos a year ago, and new evidence supports that. Dab Advisor has got me worried, thinking i could jepordise my award if ESA appeal isnt successful, and i am thinking of withdrawing. My second concern is......with the additional Severe Disability premium......if i withdraw the appeal, will i still qualify for the previous months? or will that go down the pan as well?? PLease let me know x :(

p.s...once i was awarded DLA, the JC sent me a form telling me that as i was entitled to middle rate care i could qualify for severe disability premium. I filled in the form and rang them last week, they basically said that a computer generates the forms and that they would wait until a decision was made on the ESA Appeal. Ive been in assessment phase. If i withdraw the appeal to start a fresh claim will i forfeit the back dated premium due?

Let me apologise in advance, but any answers I can give you will be constrained by the knowledge that you already have an advisor with full access to your papers.

I am assuming that there has been a deterioration in your condition(s) since the appeal was lodged, this being the case, I can understand why a new claim may have a greater degree of success.

Whilst a failed ESA claim can have a knock on effect to your DLA claim, this is not always the case.

I am afraid I am simply not in aposition to advise whether you should follow your advisors suggestion to withdraw your appeal or not.

If you do, then this would be at no fault to you, so you will not need to re-pay the ESA Assessment payments you have already received.

With regard the Severe Disability Premium, this is payable as long as you meet the requirements and are receiving Income Related ESA, even at the Assessment rate, so there should be no impact on any back payments regarding this, however, if you withdraw your appeal, payment would cease until a new ESA claim was made.

Gordon,

I really appreciate the speedy reply, i had an awful worry that my post would not be posted until lunch time tomorrow...tooo late!

So now i feel that i have obtained some important knowledge, thank you. For some unknown reason the idea of withdrawing the appeal totally frightened me, when you gear yourself up for something as life changing as this, it tends to become your life. DAB Advisor said that with all the new evidence and medical reports my claim could go alot smoother. Ive had about three hours to process the information, and tbh i am starting to believe it could be the positive way forward, thank you.

DAB Advisor also said that to remove the appeal and start again would not imply a fail on the ESA/DLA, it would allow the field to remain clear. I THINK that sort of makes sense now
