thanks again for the reply, my brother dose not go on to ESA until 7th Feb 2013 he is still being paid IB

If he is still being paid IB then he should continue to receive paymens for 365 days from the date he is transferred to ESA.
The DWP cannot have it both ways, either he is on IB or ESA, and the legal requirement is for him to be receiving Contribution Based ESA and for him to be in the WRAG, neither of which is the case if he is still on IB.
I would suggest he contact the DWP back about the letter, however, I would recommend he gets face to face advice from a trained advisor, do an internet search for "welfare advice" with the town or county.

Hi buster i had a medical ? assesment should i say feb 2012 i did not hear the out come until dec 12, my decision letter states exactly the same nearly as your brothers. Dear mrs this is to confirm that from 4th april 2012 you should have been in receipt of esa contributions based and placed in the work related activity group but due to problems processing your claim unfortunately it has a new date of 9th jan 2013 this means that you esa contribution based ends 3rd april 2013 and yes im confused as you are i have rung and asked why was there a problem processing my claim and was told they could not tell me that .

haya Millymoo, thanks for the reply,we rang the DWP yesterday as Gorden suggested and low and behold they said that the letter was wrong and he will be in the work related group until next Feb. so that will give us time to go to appeal ,so i hope this will help you in your quest

hi buster rang dwp today and yes they said i will get my payments to jan 2014. so pleased she said it was just the way the letter was worded that was the problem .
