Hi all

I get a Atos medical ever yearish and am I told "a return to work in the longer term" by the desision makers. As a get a new ESA85 to fill in prior to having the medical.

Is my claim for ESA a new claim or is it on going ? As I've just been informed that having capital my ESA income related and in the Work related group has stop and 'Ive to go in and have a talk with DWP investigators. As I haven't said about the capital.

I did think it was a new claim and was back on the contrabution base ESA although I did recieve a letter say the contrabution ESA was finishing and didn't take any actions as I thought they had made a mistake

Is my claim for ESA a new claim or is it on going ?

Hi S,

I gather that you mean an ESA50 rather than an ESA85. :)

All ESA awards WRAG or SG come with a recommended length of time before you are reassessed, (The Prognosis)

Therefore, it is an ongoing cycle of assessments and awards, see :

How often will I be reviewed

If this is the case with you, it is not classed as a "New Claim".

To be classed as a new claim, your current claim of ESA would have to be ended, and then there would have to be at least a 12 week period before a new claim was made.

You are only entitled to 365 days of payment of Contribution Based ESA (CB ESA) in The WRAG, before "Payments" cease, however if you still have a live WRAG award, then your ESA Claim is still live, even if you are only receiving NI Credits.

Once you CB ESA payments cease, the DWP may then invite you to provide your financial details, using an ESA3 Form ( Sample ESA 3 Form ), to see whether you would pass the "Means Test" with regards to your household income, capital savings and assets.

If you do pass the means test, Income Related ESA will then be paid instead of CB ESA.

If you have provide incorrect information, or failed to disclose information, this may be the reason for your interview.

You need to gain advice on this ASAP from a solicitor or CAB, etc :

Or try putting Welfare Rights/Advice into your Internet search engine with your Town/Postcode.

You also need to find out whether this interview will be "Under Caution" although I believe that they have to inform you in writing, if this is the case.

If it is, you may wish to be accompanied by an adviser or solicitor.

I know I never got the ESA3 form but we''ll see what happens with the DWP.
