It has been 17 months since my appeal, I have ME/CFS, RHA disease, type 2 diabetes, and much more. Because im not very literate i find it really hard to get help with my appeal. 2 tribunals later, both adjourned for reports (already had them needed more) then said 2 hours before tribunal it was adjourned again for a female doctor from ATOS...They said didnt have one! BUT Tribunal said I MUST have female. After many letters and months I was left in mid air! I had a woman from MIND write to them, no answer. My Pyscologist wrote, no reply, eventually a wonderful woman from CAB, who was so helpful and understanding, wrote to them and 4 weeks later I had female doctor, but, she didnt really examine me or do anything! I have to wait again I suppose! But the tribunal also insisted that I had to have a special panel that had not worked with my old GP (who had been on panel for 6/7 years at least) had not sat with him or knew him!!!???? How much longer can this go on? I need someone to be at tribunal with me, so they can help because they have the knowledge...I have tried everywhere..I am 64 and things are getting worse, especiall after reading about the new changes to DLA in April..
Can anyone advise me please.
Hello, welcome back to the forum. Congratulations on getting past the medical I remember the problems you were having with ATOS in getting a woman doctor to assess you.
I am afraid there is little you can do to hasten a new Tribunal being convened, other than to try contacting the Tribunal Service and explain how long you have been waiting, unfortunately, the restrictions on panel members are probably the cause of the delay, and for you to have a fair hearing, it is essential that these are observed.
As you had some help from the CAB, have you checked to see whether they could provide you with support at the hearing, failing that I can only suggest that you try finding someone with Welfare Rights experience by doing an internet search for "welfare advice" with your town or county. I have to warn you that you may well struggle to find anybody, this late in the process, who will be willing to take your case on.
