Nothing on this board constitutes legal advice - always consult a professional about specific problems
Standing & Sitting was created by Gareth56
The Sitting & Standing descriptors in the The Employment and Support Allowance Regulations 2013 are shown below, however on the [new] ESA50 there is a less than 30mins option, a 30mins to 1 hour option, a more than 1 hour option and a It Varies option. So how do the points allocation work with respect to the ESA50 options given that below the points for (b) is 9 and the points for (c) is 6 and for (d) is 0. So how many points do you get if you ticked the less than 30mins box on the ESA50??
(b) Cannot, for the majority of the time, remain at a work station:
(i) standing unassisted by another person (even if free to move around);
(ii) sitting (even in an adjustable chair); or
(iii) a combination of paragraphs (i) and (ii),
for more than 30 minutes, before needing to move away in order to avoid significant discomfort or exhaustion.
(c) Cannot, for the majority of the time, remain at a work station:
(i) standing unassisted by another person (even if free to move around);
(ii) sitting (even in an adjustable chair); or
(iii) a combination of paragraphs (i) and (ii),
for more than an hour before needing to move away in order to avoid significant discomfort or exhaustion.
(d) None of the above applies.
(b) Cannot, for the majority of the time, remain at a work station:

Ignoring whether ATOS or the DM will agree, if you tick the "less than 30 minutes" option then you would meet descriptor (b) "Cannot remain at a workstation for ... 30 minutes"

What about the 30mins to 1 hour option then? This is probably what I was thinking about initially!

Unless I am missing something, 30-60 minutes would fall under (c).

So just to be clear then as brain fog has descended it's:-
Cannot, for the majority of the time, remain at a work station etc etc for less than 30mins
gets you 9 points.
Cannot, for the majority of the time, remain at a work station etc etc for between 30mins and 1 hour
gets you 6 points.
Cannot, for the majority of the time, remain at a work station etc etc for more than 1 hour
gets you 6 points.
Is that it?
I just can't see why they have the 30mins to 1 hour option and the up to 1 hour option or words to that effect!

If you are referring to the ESA50 then it has options for
- Less than 30 minutes
- 30 minutes to one hour
- more than 1 hour
So you would meet descriptor (b) for "less than 30 minutes" and score 9 points, descriptor (c) for "30 minutes to one hour" and score 6 points, and descriptor (d) for "more than 1 hour", scoring 0 points.
I hope this explains it.
