Hi. I reapplied for PIP in January as last year I was awarded 4 points for daily living and 4 points for mobility.

10th January, I phoned up to start the process again.
6th February, Atos received my completed form.
28th June I phoned Atos to find out about a F2F as emailing they just kept replying that I have to wait for one, but there was a cancellation for the next Monday at 9.30am.
31th June I had my assessment.
3rd July, I had a letter dated 31st June saying that that the report had been completed and it had been chosen for auditing which shouldn't take any longer than a few days.
4th July I had a letter dated 1st July saying that the auditing was finished and it was ready to be sent to the DWP.
4th July DWP received my report from Atos.
7th August the decision letter had been sent out. I asked if she could tell me the outcome but she couldnt open the letter. So have to wait still.

Ok so I have had my decision letter. I have been awarded 4 points for daily living and 4 points for mobility.
It says
'' you said you had difficulties with washing and bathing and engaging with other people face to face. I agree you have some difficulties with these tasks''.

'' you told us you have difficulties with preparing food, taking nutrition, managing toilet needs or incontinence and dressing and undressing. Whilst you do occasionally have some difficulties with these daily tasks, I have decided that for the majority of the time you are able to manage these tasks unaided''.
I do not know how they got to occasionally as I struggle every day. How can I prove it is all the time. There is no mention of prompting or assistance either.


''You said you have difficulties with planning and following journeys. It is consistent with your health difficulties, medical evidence and medical assessment that you need prompting to avoid overwhelming psychological distress, you said you have difficulties with moving around. During the medical assessment you stated you could walk for 8 minutes at a normal pace. You were noted to walk easily and at a normal pace at the assessment. I have decided that for the majority of time you are able to stand and then then move more than 200 meters, either aided or unaided''.
I said I walk to the shop 8 minutes away once maybe twice a week and she saw me walk about 5 paces to the room after the assessment about 5 paces to the chair to pick up my bag and about 5 paces to the door out of the building.

Your only way forward with this is to request a Mandatory Reconsideration and if that is unsuccessful, to appeal the Decision. See our PIP MR and Appeal Guide

I not that this is your second claim and that on both occasions your scored 4+4, what did you learn from the first claim that you did differently on the second one?

Did you use our guides?

What evidence did you have available?

It is difficult to offer advice on so little information, one of things that claimants often do is talk about things that they do not do as opposed to things that they can not do, even though that may have been what they meant to say, the DM will not score you for things that they believe you can do but choose not.

Also they look at your condition over a period of time, a day or a week, if you do not fill in the gaps then they will make assumptions about you capabilities during these times. So for example; if you could not wash and dress when you initially get up because of joint pain from lying in one position overnight, then the DM may ask how long this lasts and whether it would be reasonable to assume if you talk about moving around after you have got up, that this pain may have eased to the point where you could wash and dress.

In regard to your walking, two issues stand out, you said that you could walk for 8 minutes at a normal pace, then you will be viewed as walking more than 600m, well in excess of the criteria for PIP, did you show that while doing this you were in pain or that by doing this you suffered pain or tiredness that would suggest that a lower distance should be considered. If you can do this two days a week, what prevents you doing so the rest of the week? Are there reasons why you must do these things even though they cause you pain or tiredness?

So you need to talk about things you cannot do, why you cannot do them (what happens if you do) and the underlying cause of that limitation, when you are affected and for how long, if you have variable degrees of limitation then you need to explain this.

So as an example;

When I wake up I cannot wash and dress due to pain in my back and hands from lying in one position overnight, if I was to attempt these tasks immediately then the pain would continue for the rest of the day and I would not be able to perform many of my other daily tasks. The pain is the result of the Arthritis in my hands and back, see medical evidence A that confirms that I have RA in my hands and back. I am limited for at least an hour after getting up by this pain and although the pain eases after an hour using my hands to pull on clothing causes the pain to start again...

If you can give us more detailed examples of how you are affected we may be able to offer more advice.

Yes I used your guides this time. I have anxiety ocd and fibromyalgia, I only change my clothes when I shower every 2 to 3 days. I sleep in my clothes. I told the HP this. When I do change I get pains in my shoulders ect.
Moving around I told her that I can not walk anywhere without pain as I have had a permanent pain in one off my heels since last year and the fatigue it causes impacts all my other daily activities.
I walk to the shops to get milk ect once or twice a week. I stay in most days because of the ocd just takes me so long to do anything and pains and fatigue I just find it so difficult to do anything.

I was given no points for cooking, but I told the HP that,
1 I have problems with moving anything at all so to cook a meal I often put empty packets/boxes back in the cupboards, fridge/freezer. All the rituals behind everything I do takes me a long time to do anything.

2 I have problems with my muscles anywhere in my body can spasm and cause me pains. My son helps me when he is home.

3 I get extreme fatigue both physically and mentally. Two days after my medical My son took me to out local hospital as I spit boiling water over my hand.
