If a couple are living together can one claim income-realated ESA and the other JSA? Or do they have to put in a joint claim?

As you are only entitled to IR ESA, you would have to make a joint IR ESA claim for you and your partner.

If one member of a couple was entitled to a Contribution Based (CB) "Benefit" as they had the requisite number of NI Contributions/Credits, any benefit that they received would be classed as household income, and offset against any Income Related (IR) "Benefit" entitlement that the other member may be entitled to.

If both members of a couple have the requisite number of NI Contributions/Credits for entitlement to payment of a CB "Benefit" it is possible that they could make individual claims in their own right.
