Insurance Pay Out was created by StressedMum
Hello Everyone,
Please can someone help me? I am in the assessment stage of ESA and awaiting a date for my medical. However, as a result of falling behind on the payment of insurance premiums, I have a policy which is due to be paid up because I am unable to pay the full amount owing - amount over £1,000 - (after a 12 month payment holiday) in order to continue the policy until its end date. The amount will bring me over the £16,000 limit for savings. Do I cancel my ESA and start a new claim when the monies come below the £16,000 savings limit or can I contact DWP and ask for my claim to be frozen until I need to claim again?
I have been a member for a few weeks and have learned a lot and not felt so alone.
I would also like to thank B&W for the invaluable guides, which helped me complete my ESA50. My friend, a social worker, was very impressed by the answers given on my form and by the thoroughness of your guides.
Many thanks.

The first thing you need to ascertain is whether your claim is for Contribution Based ESA, because you were working immediately prior to making the claim or you were transferred from another benefit such as IB or SDA. If it is then your assets and savings are not relevant to your entitlement to payment.
If you ESA in Income Related in total or in part then having savings over £16,000 will prevent payment of the benefit, but I believe that this is a Decision that the DWP should take, not you, obviously you must fully disclose your situation and provide whatever documentation they may request. So I would proceed with the application and see what happens, they will make a Decision before you are asked to complete any ESA50 or attend an assessment.
If your assets and savings significantly exceed the £16,000, which does not seem to be the case from your post, then it may be worth deferring a claim until they are under this amount.
If you claim is rejected then you can make a new one as soon as your assets and savings are below the £16,000 limit, but you may need to account for any money that has been spent so keep any and all receipts.

Gordon,
Thank you for your prompt reply.
Sorry if I did not make it clear. I am in the assessment phase on IR ESA. I have already submitted my ESA50 to ATOS and they have sent it on to DWP. This was confirmed a while ago, long before the issue of the insurance came up. The payout will result in our savings being significantly more than £16,000, which is why I asked whether I should cancel and re-apply for ESA when our savings fall below the £16,000 threshhold. This is likely to happen because we have repairs that need doing to our house and arrears to clear.
Or is it possible to have the ESA claim frozen/deferred?

If your savings and assets will clearly be in excess of the £16,000 limit then you must inform the DWP as soon as this happens in order to avoid an over payment of your ESA.
I would still leave it to the DWP to decide what happens with your claim, certainly payments cannot continue while you are over the limit, but they may allow you to continue to with the claim which would at least result in your continuing to receive NI Credits which count towards a full State Pension.
There is no way to park a claim, it either has to closed or awarded with nil payments, however, if you are already receiving ESA(IR) then this is not an issue as you can make a new claim at any time you are eligible.
It is possible to offset money against essential house repairs, but this goes beyond what we can advice on in the forum.

Gordon,
Thank you. Your reply is a big help. I will contact DWP when the monies come in and let them take it from there.
All the best to you and the other moderators. Good luck to everyone with their claims.
