Hi, this is my first post 
I have claimed ESA after a head injury, backdated to 18th Nov 2014, been told that I cant claim from Nov 14, as not enough contributions paid in tax year 2011.
I am somewhat confused, I thought it was the previous tax years that was taken into account? They have dated claim from January 15 , and said that I now qualify ?
Is this their way of getting out of paying backdated ESA, or are they correct?
My head injury has left me with constant dizziness, headache, blurred vision, confusion to name a few symptom's , so when I was contacted today, the advisor from DWP was acting like it was not rocket science and I should know 'exactly' what he was talking about.
I have an appointment with CAB but if this is correct then it is a wasted journey and as i am not well I could do without the extra stress of going out.
I hope somebody can help me, I am going out of my mind with worry.

Contribution Based ESA uses the last two full Tax Years prior to the year that a claim is made, for any claim made in 2014 this was2012-12 2011-12 and 2012-13, for any claim made after Monday 5 January 2015 the Tax Years being used are 2012-13 and 2013-14, you should be able to backdate your claim to the 5th providing you have a Fit Note to cover you from or before this date.

Hi Gordon,
This is what CAB was informed me, but the decision maker @ DWP were having none of it.
I did think the call this morning was due to me paying late contributions, they are now up to date,
and being that they have made a decision based on my contributions I guess it doesn't matter that they were paid late, as long as the account was upto date.
All he kept saying was from Jan 15 they would be able to accept claim , but from Nov 14 they would need to base it on 2011-12 contributions.
Just didn't make any sense, apart from saving them from backdating it!
They have a backdated fit note 18th Nov - 12 Jan , and then another 12 Jan-12 Feb.
I have seen consultant today, and he wants an MRI scan because of continued illness.

sorry I just replied and have re-read your reply, have you made a typo re;-
2012-12 and 2012-13, for any claim made after Monday 5 January the Tax Years being used are 2012-13.
Do you mean 2011-2012 not 2012-12?
