I had a letter from the DWP on an A164 form today. They are asking why I get monthly payments from XYZ co and is it permanent health insurance. They say if it is (which it is) am I still 'employed' by the company who set it up. I am technically an 'employee', though have a permanent disability for which I previously got a lifetime award for invalidity benefit and last year after a medical moved to ESA Support group. What are they up to, please help. Thank you. This has been written for me, so any response to a response may take a while. Thanks again.

We have a number of members have a similar problem when converted to ESA.

The first question is did you inform the DWP of this income when you were receiving Invalidity Benefit, if you did then it is likely that the DWP have lost this information and that is why they have contacted you about it.

If the payment was disregarded under Invalidity Benefit then it should continue to be disregarded under ESA. It might help if you have documentation that confirms this was the case.

If you have not previously reported the income to the DWP, then I would recommend that you get face to face advice from a qualified advisor, so an internet search for "welfare advice" with your postcode, town or county.

Thank you so much for your response. I did inform them, and HMRC took the annual IB sum from my personal allowance. Now I need to prompt them to do the same with ESA, because they have not worked out they need to do this and I had a coding notice with a massive increase in code, meaning unless they sort it out I will end up owing them money, which I do not wish to do. I am very grateful for your reply. I've had good help, inc the person typing this, but it's such a difficult road.
