PIP Appeal Allowed !! was created by raindaisy
Hi B & W
Just back from PIP appeal .
Grueling to say the least!! One point ..I will now keep a diary of how my FM affects me. Because , they asked "tell me about a typical day". and I had to focus on February , when the decision was made. I went blank.
I scored 0 points on daily living and 8 points on moving around ( 2 (c) )
This is a claim , i started last year, because I was advised to. I was very reluctant because I felt I managed this condition myself. I am also a carer to my husband.
I procrastinated from March til December, and was told by DWP my claim was still "active"..so I completed the form and sent it in. Had F2F in January. Scored 0 .
I did have a rep, who said i should appeal. I did. And today the appeal was allowed!!
I want to thank B&W for all the help , because thou I did have a rep, there is still a lot of personal input you have to put in, your guides , info, forum and help are so well worth it.!!
The whole process is hard. But i am really glad I persevered.
the backdated amount for esa and pip is £2, 600 ! I also appealed BT and that was also allowed after 2 years of fighting! ...Believe me, as someone who has permanently been living in an overdraft since leaving work 2 years ago , it is a major relief!!
if anyone reading this has any doubts , go for it, nothing ventured nothing gained. I am sad this illness has come to stay, but I remain positive, ( well, today i do ) that it will not take me out .
That's me done now. Gall bladder op done 12 days ago. overdraft cleared. tribunals out the way. OH will be next as he is indefinite DLA, but getting so much worse.
Time to focus on OH as heart appt is here and lung appt in august. I can clear my dining room table ( aka a bedroom , but not a bedroom really ) and get my sewing machine out and chill.
Thank you again !!

So here we go again!!!
Tribunal decision notice in July last year , award LR of mobility until March 2017. The decision letter from DWP stated until March 2016, contrary to the tribunal notice.
Received a PIP form this morning , "we're looking again at your PIP" . Form must be completed by 11 April 2016.
I have read on here reassessments for PIP do happen before the end date , so I take it , i am once again on the merry go round and the DWP are perfectly entitled to reassess when they say , and not the Tribunal?
I had a F2F assessment last time.
I also had an ESA assessment and i am on ESA (CB) in the SG.
My husband is a stroke survivor with post stroke central pain, now in heart failure , he is on DLA and ESA (CB) in the SG. His letter for re assessment has not arrived....yet.
any advice would be welcome .

the plot thickens . Received a letter from DWP re PIP. This now says " the rates for benefit have been reviewed and these will take effect from 11 April 2016"
"you are entitled to mobility component PIP at the standard rate ......from 12 March 2014 to 11 March 2017 ( both dates included)"
"following this review your total entitlement has remained the same "
From.this am I right to take it. that the review has gone ahead , without me having to complete form and send in by 11 April 2016 ??
they have reviewed it now and it is in line with the tribunal decision

Hi rd,
You need to contact PIP, as one of these letters may just be your annual PIP entitlement letter :
PIP Helpline :
Telephone: 0345 850 3322
Textphone: 0345 601 6677
Monday to Friday, 8am to 6pm
If your current PIP Award runs out in March 2017, then it would be the norm to receive your renewal forms 12 months before the end date of your fixed term award.
See : This Ongoing Topic.
You should treat this renewal/reassessment as if it was your first, and not assume that The PIP Assessors will have any access to evidence that you provided in your previous assessment.
You can use, "older" evidence but you must make it clear that the resulting limitations suffered have not changed nor diminished since the date of the evidence.
It would help if you can obtain a current letter of support from your G.P. reflecting this.
You should be aware that you will be reassessed afresh, and as a result of this review your current PIP Awards could remain the same, be increased, reduced or taken away altogether.
Any awards made as a result of this review will take effect from the date of the decision made at review rather than from the original end date of your current existing award.
