Hi there is not much information but I will try & explain. If you apply for ESA, but you are not awarded any money due to not paying NI contributions in the previous 2 financial years & also not being aware if I could claim. Also unable to claim income related due to personal pension payments. Is it best to continue to keep the claim open, send in medical notes, complete the ESA50 & attend medicals so they continue to credit my National insurance for my state pension. Any advice would be appreciated

Providing you can cope with the regular re-assessment then it is worth your pursuing an ESA(IR)claim with no entitlement to payment as you will receive NI Credits that count towards a Full State pension.

You will not be required to undertake Work Related Activity even if placed in the WRAG.

Thank you Gordon. If you are placed in the support group would you have to still send in medical notes ? Or would that cease ?

If you don't get any financial award but keep an ir ESA claim open will you be entitled to housing benefit , council tax support & other passport benefits? Sorry for all these questions it's just rather confusing

Once an ESA award has been made and gone into payment, WRAG or SG, then there is no requirement for further Fit Notes.

The eligibility criteria for HB is substantially the same as for ESA(IR) so if you have calculated that you would not be eligible for ESA(IR) then I would not expect you to be for HB either and as a consequence any of the passported benefits.
