Still in ESA Assessment phase since Feb 2014

Hi folks,

Wonder whether you can point me in the right direction?

My son, who underwent brain surgery in 2013, n=and has subsequent medical difficulties due to acquired brain injury has been claiming ESA since Feb 2014. He lives alone and receives only assessment phase amount. He is 27 years old.

Last month he received a letter to attend a medical at 9 am in Exeter, somewhere he cannot access at that hour, and without difficulty die to the effects of his injury and his medication. We sent in an letter explaining that due to the complexities of his condition, the medication he takes and the detrimental effect attending the medical, and possibly being found fit for work would have on his recovery and wellbeing. We asked also that he be assessed by a practitioner who has neurological qualifications. He ensured his GP had copies of everything we sent to the assessment centre.

Within 24 hours he received notification that his medical was to be postponed until a later date and time slot.

A day later he received further communication to say his medical had been cancelled outright, but with no explanation.

Clearly we have a couple of concerns:

1. Why have they cancelled his medical?
2. What should he do, as we feel being in assessment phase this long is far too long and damaging his wellbeing?
3. What is out next step?


Any advice would be gratefully received.

There are multiple reasons why the appointment was cancelled and not re-arranged, at one end of the spectrum it could be because they have decided that they have enough information to make a recommendation to the DWP, at the other, it could be as simple as needing a doctor to be available to carry out the assessment and there is not one available within the time slot that they can book within (usually three weeks).

You haven't mentioned a home assessment, would this be a practical alternative, if an assessment is still outstanding? If it is then you will need your son's GP to write to the Assessment Provider explaining why he cannot attend. A home assessment may delay things further!

I'm afraid the only way you will know is to contact the Assessment Provider and ask!

Without knowing why no new appointment has been made it's difficult to offer detailed advice. If they have gone with a paper assessment then his file will be returned to the DWP and a Decision should be made in the next 2-3 weeks.

If it is due to resources then although you can escalate the problem to your son's MP, there may be little that they can do and what they can may make it more difficult for your son, for example an appointment at another assessment centre, but perhaps further away.
