In June 2015, I attended the Jobcentre to sign on (I've been claiming JSA). I suffer from hardening of the arteries in my legs, which makes walking difficult and tiring. The advisor I spoke to advised me that maybe I'd be better off going to my Doctor and getting a Med Cert to show that I was unfit for work and should claim ESA. Long story short, I got a 12 week Med Cert from Doctor and submitted to ESA, I was sent for health assessment where I was assessed as (surprise, surprise), fit for work. I went back to my Doctor, who gave me another Med Cert for 8 weeks which I submitted to ESA, who promptly stopped my benefits and advised me that I wouldn't receive any more benefits until I went for another health assessment. I went for 2nd health assessment, where, again, I was assessed as fit for work. I signed on again on the 17th of December 2015 and my JSA is to be continue from that date. I haven't been paid any benefits from anyone for the intervening period from the 30th of October to the 16th of December as JSA say I was not fit for work or was not actively seeking work and not entitled to JSA, The ESA are saying I was assessed as fit for work and not entitled to ESA, what can I do?

I'm afraid I can't think of any other options to cover the lost benefit, although you can in principle back date a JSA claim by up to three months, the reality is that it is almost impossible to receive payment for this as you need to show that you were fit for work and available to seek work and the DWP have already ruled that they do not believe that this was the case.

You may be able to arrange a Benefit Advance if your first payment will take a while to be paid. You need to speak to your JC+ advisor about this.
