Hi, what is the situation now if after you have had your WCA assessment and are declared fit for work and have had your ESA stopped, you then go on to claim JSA. If your health were to decline can you go back to your GP and get signed off sick and go through the whole procedure again

Hi Homer,
You should be able to reclaim ESA in that situation (although we recently heard from someone who was told otherwise by DWP!) as long as DWP accept your evidence of deterioration. Otherwise you would not be paid until/unless found to qualify for ESA at assessment.

Mrs H is correct, you will need to show that you have a new condition and that there is a reasonable prospect of an award, if you can, then you should receive the ESA Assessment rate until a Decision is made.
If a Decision Maker does not accept your reasons then they can deny payment but your file should still be forwarded to Maximus for an assessment, the Decision not to pay can be challenged.
