hi i have a filled in an SSCS1 form to attend a tribunal after being refused pip for my autistic son who also has phobic panic disorder. he was getting the higher amounts of dLL. we did go to the medical but because of the hard work and bribery i had done with my son , apart from refusing to speak at first without coaxing from me,he answerd there questions just saying yes to all, because he was saying what he thinks they want to hear. so now the cab have helped me by wrting a letter but that didnt work. i was gobsmacked that he had been awarded the same 4 points on mobility and 2 for personal care which isnt enough points to qualify. my son doesnt go out of the house at all without me or his dad. he needs to be watched at all times. he panics and is actually sick at the thought of going anywhere new or familiar. i have decided that if i cant get him to go to the tribunal,that if its clearly causing him distress, that i shall go on my own. i do have power of attorney to speak for my son. the trouble is that iv been ill recently and now i find that due to my illness i cant deal with things the same as i used to. my speech isnt as fluent, i forget words and what i want to say. its taken me ages to write this. i was wondering if it would be best to take someone with me, but i dont know who. maybe i should hire a solicitor. im not sure whether that may be a good idea or not . i need guidance. thankyou

If there is a possibility that your son may not be able to attend then you need to contact the Court once the appeal has been accepted, it will be down to the Judge to decide whether to allow you to attend in his place.

I would be cautious of using a solicitor, it will cost you money and benefit law is a specialist area that most solicitors have no experience of, if you do go down that route then make sure investigate their experience in this area and their track record for Social Security appeals.

As an alternative you may be able to get assistance from a trained Welfare Advisor. Do an internet search for "welfare" advice with your postcode, town or county.
