Got my pip decision today and only got standard care rate! Strange as i had high rate mobility and now they gave me only 4 points!! The decision maker letter is absolutely crap and wrong!! I read all the info on here and now asked for a second decision before I appeal!! What can I do?? I don't think they contacted any of my doctors

Sorry to hear that your award is not what you hoped for,

I'm afraid, in the vast majority of claims neither the Assessment Provider or the DWP contact the claimants medical professionals.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Hi all well just received my MR letter and from the original decision I had 0 mobility and now have only 10 points for mobility which I personally find wrong still! I told then due to the effects of medication I don't make budgeting decisions, my wife does as I get confused, they have now recognised the effects the medication has on me but even with a letter my gp wrote about my movements and that I can move around too long without being in chronic pain they said I can stand and move more than 20m but no more than 50, but in constant pain moving 1 meter! I scored 0 for planning a journey unaided which I explained it depends where I'm going. if not I would use a satnav or usually my wife drives anyway. They wrote the following" The letter from your GP confirms significant pain and problems with balance when mobilising. you have however been allowed to keep your driving licence despite your mobility being impaired and the side effects of the medication, this suggests you have the physical ability to mobilise out of the house and achieve a distance of between 20meters and 50 meters reliably and repeatedly using an aid " What has this got to do with my licence? And I don't drive often as I'm in no state to and am usually being driven around by family, friends, taxis, and public transport when I'm aware of things! I'm at a lost of what to do now! The dla is still the same but also even after the MR and letter I wrote things haven't changed and the mobility part I believe even though I have now scored 10 points I still think is wrong!! What can I do??

Hi Dan,

I'm sorry that the MR did not come up with the decision you hoped for. We don't see successful MRs very often, so you obviously made a good argument!

It is up to you to decide whether you want to accept this award or continue to appeal. You have 1 month in which to submit an official appeal form (which can be fouind online) to the Tribunal Service.
