PIP decision confused help !!! was created by jane winters
Been awarded pip daily living at standard rate, missed out on enhanced rate by 1 point , only awarded 4 points for mobility component , suffering from anxiety / panic disorder and also depression, always got DLA for mobility at the low rate as I always need to be accompanied out doors, even in familiar places, been awarded pip because To quote " I need prompting to go out" 4 points. Yes do need prompting due to the depression but also need to be accompanied because of the panic when out doors . help !! Get so anxious for days before going out , don't eat , afraid of being sick this leads to diabetic hypos , just worried sick I will become agrophobic again , going to ask for an MR do they look at your DLA claims from the past and take any of them in considering pip ?? More confused than normal !!! trying to look on the bright side ,was never awarded the care component of DLA , any advise from anybody would be a great help, don't think I'm strong enough for an appeal thanks x

You will need to show "overwhelming psychological distress" to get an award for Mobility based o your post, have a look at the PIP Claim guide for more details.

If you want to challenge the Decision then the first stage is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Thanks Gordon , Yes I do suffer physiological distress so much so that my Doctor has agreed to phone appointments but will phone and ask if based on my GP's report and my phycologists reports , I did not need a f 2 f as they said they had enough evidence thanks again x

This is all about crossing the "T"s and dotting the "I"s, the requirement is you to have "overwhelming" psychological distress.
