Hi to all,

I've just received my PIP renewal assessment decision back from the decision maker at the DWP.

The DM has awarded me enhanced rate for my mobility (12 points) + received 6 points for a combination of dressing undressing (2) washing bathing(2) mixing with other people(2)

so in total that 6 points for the daily living activities.

now preparing & cooking food the DM scored me 0 points ???? which means I don't even reach the 8 points for the normal rate for these activities?

So in effect the DM decided to not even award me 2 points, which would had scored me the 8 points needed for the normal rate of this component.

This is a PIP renewal and came 18 months earlier prior to the re-assessment which would had been in april 2017.

but prior to this new DM decision, I was receiving full enhanced rates on both components ie daily living & mobility.

So now for some ridiculous reason/s I can prep & cook foods.

given the fact I cant and ive already been to tribunals over this activity in the past & won!!!!!!

So dear moderators please could you give me any advice on my next move.

1 - for re-consideration
2 - obtaining a pip report
3 - starting an appeal process

Id rather I had been given enhanced rte on the daily living components, as I rely heavily on my family & friends for everyday help ie cooking/washing/bathing/cleaning/all houseworks/shopping etc.

the enhanced rate for mobility is welcomed obviously, but I rarely leave my home and walk etc due to illnesses.

It seems relative strange not to had awarded the minimum points for the preparing /cooking of foods would one agree, given the facts ive stated.

its like saying I cant cook or prep food for numerous reasons, ie medications, crippling dieseases in hands spine etc, as it cause me be dizzy, fall asleep , or burn ,cut myself or drop things, which is a danger right?

But DM says no ok you can do this with such problems, just prep food cook it, if you hurt yourself or someone else in the process that's ok. but in the meantime I havnt given you any points??

what a laugh lol

You should certainly query why there has been a change of award when there appears to have been no change to your limitations and no change to the PIP descriptors.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

thanks for your replies and advice.

I will be going through the pip assessors report with a fine toothcomb as soon as it arrives to my home address.

then phoning ? putting in writing a mandatory reconsideration request.

I just hope I can technically justify where they went wrong in the report, which led the DM to fail me even for the standard rate of daily living component by a measly 2 points.

I await the report, and I will keep you all posted.

thanks for all replies
