I am 68 years old and missed the cut off date of having to change from DLA to PIPS by 8 days. I have been on higher rate mobility allowance since 1996 when I was involved in a car accident. I was taken off higher rate mobility on DLA and given the standard rate under PIPS plus I was given standard rate of the care component which I had not previously had. I feel very aggrieved about my mobility allowance as I truly cannot walk any distance with being in pain. I appealed and before the hearing actually started was asked if I had taken advice, I said I had from CAB and they had said I could get what I was asking for, keep what I had got or lose the lot. The judge said ' and it looks like you are going to lose everything' I asked why and she said she could not tell me. There was a man there from DLA who was very nice and he suggested that I have an adjournment of the appeal. Somewhere in the conversation the judge said ' you are a carer for your husband aren't you' and I said. My husband has had a stroke but is not physically impaired and I explained that his speech is affected and he is not able to monitor his own medication of make food for himself. He does wash and dress himself and gets in/out of bed himself. I told her I do not and cannot lift him in any way. My new appeal date is due on 10th and I know this is short notice but I am a total wreck. Can anyone advise me what to do please

We are limited in the advice that we can give you as we have no sight of the papers involved in your appeal.
This warning is only given when the panel believe that there is insufficient evidence to support your current award let alone the increase that you have appealed for. You should take the warning seriously!
If you can get face to face advice then they may advise you differently and based on your papers, but without this advice I think you should seriously consider withdrawing your appeal.

I have been advised by the CAB to withdraw the appeal keep what I have for the moment and several months down the line ask for a re assessment

From what you have said, withdrawing the appeal does sound the safest course of action.

I have withdrawn the appeal, but what I forgot to say was the CAB advised me that they thought I had enough health problems to get a couple more points on the care component which would have given me the top rate
Too late now though, I really could not afford to lose what I had been awarded.
Good luck to others out there facing this disgusting inquisition.
